Fathers are getting more and more time with their children. This has been the trend for a number of years. The courts now recognize that a healthy bond between fathers and children is important to a child's development. There is no presumption in the statute that favors mothers over fathers. Instead the statute focuses on what has been the history of father and mother with respect to the children in caring for the children on a daily basis, taking the children to the doctor, interacting with the teachers, and involvement in the child's activities. The statute also considers whether a parent has the capacity to take on these parental roles.
