Should I appeal my divorce?

It extremely common for a spouse to be unhappy with the judge's divorce ruling. When this is the case, you always have the right to appeal, but you may wonder whether it is the right thing to do and whether an appeal will be worth your trouble.

This blog will offer a brief overview into what the complexities can be when going through a divorce ruling appeal, and whether it might be worthwhile for you to engage in one.

How long can I wait?

You must decide whether you want to appeal the divorce ruling in a certain amount of time. This may be less than seven days, but could also be over a month. Therefore, it's best to check up on the time frame first. If you fail to file in time, you may not be able to do so at all. Some jurisdictions allow to file late as long as you pay a fine, however.

How much will it cost?

The initial filing for a divorce appeal can reach several hundred dollars, therefore one of the most serious downsides of filing an appeal is that they can be expensive. As the appealing party, you will be responsible for the copies of all pleadings, written opinions, exhibits and briefs.

How long can my case be pending?

Family law divorce appeals usually take several months, except for rare emergency appeals. Many things can happen within your family during this time which can be hard to predict. This may make an appeal moot or even irrelevant to the new circumstances.
